Senator Proposes Legislation to Criminalize Watching Pornography and Ban Sexting Outside Marriage

An Oklahoma state senator is pushing for legislation that would criminalize watching pornography and ban sexting among individuals who are not married. Senator Dusty Deevers plans to introduce the bill next month, aiming to prohibit the consumption or production of sexual content lacking serious literary, artistic, educational, political, or scientific purposes or value.

The proposed law defines 'obscene material' broadly, including depictions or descriptions of sexual acts, sodomy, masturbation, sadomasochistic abuse, and acts of excretion in a sexual context. The bill carries potential prison sentences of up to a year and fines of $2,000.

It also allows residents to sue those producing or promoting such content for $10,000. Married couples would be exempt, provided they share explicit content created together. The legislation would impact social media sites hosting explicit content, potentially limiting access within the state.

However, there are concerns about potential violations of the First Amendment, and the bill includes a provision to sever constitutionally valid applications from invalid ones as determined by a court.
